What is AB 723?
AB 723 affects how digitally altered listing photos can be used in MLS listings and marketing. The goal is simple: transparency for buyers. Buyers should be able to clearly understand what's real and what has been digitally modified.
This applies to MLS listings (CRMLS and others), Zillow, Redfin, Realtor.com, property websites, social media, and marketing materials.
Standard Editing vs. Altered Images
Standard Editing
No disclosure needed

✔ Brightness and exposure correction
✔ Color correction and white balance
✔ Window exposure balancing
✔ Blue sky replacement
✔ Minor lawn or grass improvement
✔ TV screen glare removal
These edits improve image quality but do not change the property itself.
Altered Images
Disclosure required

⚠️ Virtual staging
⚠️ Virtual decluttering (removing furniture or items)
⚠️ Adding or removing objects or features
⚠️ Major landscaping or exterior changes
⚠️ Virtual twilight / day-to-dusk images
⚠️ Any AI-generated modifications that alter reality
If a buyer could walk into the home and see something different than the photo, it likely requires disclosure.

It likely needs disclosure.
AB 723 Disclosure Requirements
Clear Disclosure
A clear disclosure must be included near the image, simple and easy to understand (e.g., "Virtually Staged")
Original Image
The original, unedited image must be available via link, QR code, or accessible page
Transparency
Edits should not mislead buyers. When in doubt, simple transparency is always the safest approach
